What is Testamentary Capacity?

Testamentary capacity means having the mental ability to make or change your will. To have testamentary capacity, a person needs to understand what a will does, what you own, and who might expect to inherit from you.

They also need to be able to make those choices freely, without being confused or influenced by anyone else.

In simple terms, it means you fully understand your decisions about who will receive your money, property, or belongings when you die.

What is Lasting Power of Attorney (LPA)?

In simple terms, a Lasting Power of Attorney is a legal document that lets you choose one or more person you trust to make decisions for you if, one day, you can’t make them yourself (you have lost capacity).

There are two types — one for your health and welfare, and one for your property and finance.

Making an LPA means that, if you ever become unwell or unable to manage things, your chosen person can step in and help make sure your wishes are followed.
